Non-profit community support effort rules

Enhanced Rules 2020 For Community Support During the Covid 19 Crisis

RPrime Foundation (RPrime), a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is supporting local communities grants, financial support, support in kind, and other related non-profit efforts – pursuant to Washington Administrative Code 230-03 (including sub-code 152 and others). By supporting these charitable purposes, you agree to the Rules and Regulations set forth below and you are bound by these rules and regulations. RPrime’s interpretation and application of the rules and regulations shall be final.

A current non-profit community support effort supports Van Gogh Coffeehouse Seattle at 8210 35th Ave NE, Seattle, WA 98115. Entries will not be accepted after June 1, 2020. The Grand Prize Drawing will take place on June 10th. An independent auditor will supervise all aspects of the drawing and will be open to the public upon requests, but the winner does not need to be present to win. The number of entries is unknown, but the chances of winning decrease with a larger number of entries, and increase with a lower number of entries. The chances of winning are based on the number of entries. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.

If they apply, The Grand Prize Winner assumes all fees, local, state, and federal taxes (including but not limited to income taxes based on the value of the prize). RPrime takes no responsibility for any tax liabilities. Consult your tax advisor. This offer is void where prohibited by law, and all federal, state, and local laws and regulations apply.

By entering this non-profit community support effort, entrants accept and agree to be bound by all the rules, limitations, and restrictions set forth here. RPrime will provide purchasers all information as required by WAC 230-11-015. Other rules and regulations may apply. Please contact RPrime if you have any questions. RPRime’s interpretation and application of the rules and regulations shall be final.

By entering this non-profit community support effort, each participant releases RPrime, its directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind caused by participating in the non-profit community support effort or winning any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold RPrime harmless from any and all losses, damages, rights, claims, and actions of any kind arising in connection with or as a result of participating in the non-profit community support effort or the winner’s acceptance or use of any prize. A participant’s sole and exclusive remedy for RPrime’s breach shall be limited to the return of the purchase price paid for his or her entry or entries. In no event shall RPrime, its directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

The non-profit community support effort Grand Prize Drawing will be held on June 10, 2020, from all eligible entries. Winners need not be present to win. The winner of the non-profit community support effort will be posted on the RPRime web site by June 22, 2020, or before and/or by sending a self-address, stamped envelope to the RPrime Foundation offices at 2001 6th Avenue, Suite 1610, Seattle, WA 98121 one week after drawing.

Anyone 18 years of age or older may enter. RPrime employees, members of the Board of Directors, authorized agents and employees thereof, consultants, attorneys, independent accountant firm, and their spouses and children living in the same household are excluded from participating and are not eligible to win a prize. All federal, state and local laws and regulations apply. The non-profit community support effort is void where prohibited or restricted by law. An affidavit of eligibility may be required from prize winners.

The Grand Prize for the non-profit community support effort is an evening cruise throughout Puget Sound and will take place within the Puget Sound area of Washington. In the event of circumstances outside of the control of RPRime such as but not limited to: fire, earthquake and other acts beyond the control of RPrime as determined by RPRime are beyond our control and RPrime does not provide any guarantee or warranty, expressed or implied, and accepts no liability or responsibility regarding the ability to provide the evening cruise in such an exception. No express warranties are given and no affirmation of RPRime by words and/or actions will constitute a warranty.

Any controversy or claim arising out of or relating to the contract, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (pursuant to its expedited procedures) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
